Deposit and Payments:

In order to secure your stay, 50% of your reservation is due within 24 hours of your reservation. The total is due 30 days prior to your check in date. If you have a credit card on file it will be charged automatically unless other payment arrangements are made. Please review your reservation and make sure all the information including check in and check out dates are correct.

Payment Terms:

Credit Cards, Electronic Funds or Electronic Checks are accepted. There is a $75 charge for all returned checks plus the cost of collection.

Credit Card Authorization:

I understand and consent to the use of the credit card provided without original signature on the charge slip, that an email of this agreement will serve as an original, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after the rental is vacated. Additional charges may include: excessive cleaning fees; damages beyond normal wear and tear and unreturned keys. All charges not covered under the Damage Protection Insurance may be included.

Damage Protection:

It is required by Shell Seekers Vacations that in lieu of a security deposit, Guest must purchase Vacation Damage Protection. The charge for the plan is $89 (non-refundable) and provides basic coverage for accidental damage to the property and its contents. An inspection of the property will be conducted following your departure.
Should an inspector find that the unit is inordinately dirty, items are missing from the property, or there is obvious damage to the property and/or its contents, Guest will be notified and advised of the claim process. Shell Seekers Vacations reserves the right to charge Guest for intentional or negligent damages. A credit card will be held on file for any such damages, as Guest is personally and financially responsible for such damages.

Travel Insurance:

Travel insurance is highly encouraged, and will reimburse you in the event that unforeseen events disrupt or cause delay or cancellation of your trip. The cost of this insurance, provided through Rental Guardian, is 7% of the total cost of the rental rate. A complete review of this policy is available at www.rentalguardian.com. Rates:

Terms and applicable taxes are subject to change without notice. We reserve the right to move Guest up to 30 days in advance to a comparable property or refund the Guest the amount paid.

Occupancy Restrictions:

Guest is responsible for insuring that the number of occupants at no time exceeds the advertised maximum sleeping capacity of the of the property as stated in the property description. This shall exclude infants and/ or toddlers occupying cribs or travel sleepers. Furthermore, no one under the age of twenty-five (25) may occupy the property as Guest or without adult supervision. Violation is cause for eviction without refund of any kind, and will result in liability for any and all damages that have resulted due to this infraction.

Cancellation Policy:

a.) Cancellation of the reservation is acceptable and without penalty if notice of cancellation is given within seven (7) days of making the reservation. Following the seven (7) day grace period, forfeiture of the advanced reservation payment will be enforced unless Guest chooses to apply the payment to another rental within the same calendar year through Shell Seekers Vacations. If cancellation is made within thirty (30) days of arrival, and the final payment has been submitted, every effort will be made to occupy the property with a new reservation. Should a new reservation be secured, a full refund minus $500 will be returned. Guest has the option to re- schedule the reservation for dates within the same calendar year at a rate equal to or greater than the paid rental rate.

b.) Hurricane or Storm Policy. In the event that a mandatory evacuation is ordered during the time of stay, a refund will be issued for any unused portion of the rental fee collected for guests in-house or for a guest scheduled for arrival in an area that has been placed under a tropical storm or hurricane warning. Inclement weather does not permit execution of this policy with regards to refund of rent or deposit.

Check In and Check Out:

The rental period begins at 4:00 p.m. on the day of arrival and terminates at 10:00 a.m. on the day of departure, unless prior arrangements have been made. Early check-in’s or late departures will incur an extra charge of $40. The properties are professionally cleaned and inspected before and after each rental to ensure that all guests have a clean, comfortable stay. Please be thoughtful of renters who may be checking in on the same day that you checkout. Late check-outs, with out prior consent from Shell Seeker Vacations, will be charged a fee of $75.

Community Rules:

Guest agrees to abide by rules of the community. These may be posted in the unit or at the community pool or office. These rules may change from time to time.

Pet Policies:

Pets are permitted only in units specified as “Pet Friendly” properties. This policy refers only to dogs, and no more than two (2) are permitted during the accommodation period. A non-refundable Pet Fee ($200 for the first pet, and $100 per additional pet) is required to permit pets on-site, and failure to secure permission through payment of the Pet Fee will result subsequent actions by Shell Seekers Vacations, not to exclude eviction.
Guest pets must be treated for fleas and ticks prior to arrival. Guests must pick up after pets and tightly tie the remnants in a plastic bag if staying in a Pet Friendly Unit. Pets are not allowed on the furniture and all pet hair must be cleaned up prior to departure. A $250 fee will be charged if there is any report of pet hair on bedding and sofas. Guest pets must be leashed at all times when outside of the unit and under no circumstances are Guest pets allowed on the beach. The violation of any terms of this pet policy subjects the guest to additional fines or termination of the rental period. Guest pet policies and unit availability are subject to change per county and association rules and regulations at any time.

Falsified Reservations:

Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.

Golf Carts And Bikes:

Golf carts and bicycles that are offered as part of the rental property at no extra charge are considered ancillary products. These items are serviced and maintained on a regular basis and should be in working condition upon arrival. In the unforeseen event that one of these items needs repair during your stay, every effort will be made to repair the item in a timely manner; however, no refund of any kind will be issued as a result of loss of use. Any violations to the stated policies will result in fines and fees to the cards on file greater than or equal to the total rental amount to be determined by Shell Seekers Vacations.

Obligations Of The Parties

Lost, Stolen And Misplaced Items:

Neither Shell Seekers Vacations nor the Property Owner assumes liability for items that may be lost, stolen misplaced or damaged during the duration of the rental period. In the event that personal items are left behind after departure, please contact our office to arrange return shipping. Guest will be responsible for any and all shipping and handing fees.

Parking:

Parking restrictions must be observed at all times and parking is permitted in designated areas only. Any towing and ticketing costs are the responsibility of Guest.

Quiet Enjoyment:

Local county ordinances prohibit unreasonable disturbance of others. Decibel levels are not to exceed fifty (50) decibels at any time between the hours of 10:00 P.M. and 7:00 A.M. Violation and breach of the peace includes music heard on the outside of the property with windows and doors secured. Unregistered guests of the property are required to depart no later than 11:30 P.M. Repeat offense of this policy will result in eviction without refund

Lockout Areas:

Properties with areas such as garages and closets that are designated off-limits to guests must not be accessed or attempted to be accessed during occupancy. Violation especially by forced entry will be reported to local authorities as breaking and entering. Please regard any and all locked spaces as those for owner use only.

Conditions Of Premises:

Upon departure the premises must be left in the order in which it was entered. This includes removal of perishable items, and placement of garbage in designated areas. All dirty dishes, glassware and flatware should me placed in dishwasher and the cycle started. Windows and doors should be secured, and thermostats should be adjusted according to the season. 78º in warmer months and 67º in the cooler times of the year.

Indemnification

In the event of any accident or incident that causes damage, bodily injury or casualty to the Guest or any member of the occupying party, by signature of this agreement all occupying parties agree collectively to hold harmless and waive the right to hold negligent the Property Owner and/or Shell Seekers Vacations’ and any and all representatives thereof. This is to include any and all recreational items such as golf carts, scooters and bicycles.

Interference With Stay:

Shell Seekers Vacations will make every effort to stay informed of pending construction, closure of facilities related to the property, upcoming events such as concerts that can cause disturbance, etc. However, Shell Seekers Vacations shall not be held responsible for such occurrences that are beyond our control.

Right Of Entry:

Shell Seekers Vacations may enter upon the leased premises at any time for the protection and preservation of the premises, in the event of an emergency, or known or suspected violation of policies set forth by this
agreement. When entry is necessary for repairs or services agreed upon by both parties, Shell Seekers Vacations will make every effort to provide ample notice of three (3) or more hours. Inability to extend such notice for reasons set forth above shall not however prohibit entry.

Governing Law:

This agreement shall be governed by the laws of the state of Florida. Each of the parties irrevocably consents to the exclusive personal jurisdiction and governing laws of the federal and state courts located in the state of Florida and within Walton County as applicable, for any matter arising out of or relating to this Agreement.

Entire Agreement:

This Agreement constitutes the entire agreement of the parties and supersedes all prior or contemporaneous oral or written agreements concerning this subject matter. Any modifications or changes to this agreement must be in writing and will be deemed null and void without proper signature from the Guest and a representative of Shell Seekers Vacations.

Additional Things to Consider for Spring Break Rental

Reservations made for underage travelers, and/or young singles groups, will not be honored without an accompanying adult couple staying in the unit at ALL times. Guest is responsible for insuring that the number of occupants at no time exceeds the advertised maximum sleeping capacity of the property as stated in the property description. Furthermore, no one under the age of twenty-five (25) may rent or occupy the property as Guest, or without adult supervision. There must be one person over the age of 25 for every four (4) occupants. Violation is cause for eviction without refund of any kind, and will result in liability for any and all damages that have resulted due to this infraction.

Any violators will be evicted according to the attached contract with forfeiture of all monies. No rental property may be sublet without written permission from Shell Seekers Vacations. Your reservation is not transferable to another party without written or emailed permission & acknowledged in writing from Shell Seekers Vacations and all parties may be asked to present valid Identification.

Parents, and/or adults over the age of 25, are not allowed to check-in and then leave the property to underage guest(s); they must stay at the property throughout the duration of the reserved stay dates.

Any group whose behavior creates a disruption or interferes with their neighbor’s reasonable peaceful enjoyment of their property will be subject to eviction and no refund of any kind will be made. Reservations made during Spring Break must be paid in full at least 7 days prior to the check in date. Shell Seekers Vacations reserves the right to inspect any property with or without notice to the guest.

Shell Seekers Vacations Bicycle Rental Agreement and Policies (if applicable)

Bicycles are rented out clean and in proper working condition and must be returned in the same manner.

Bikes are maintained on a daily basis. It is the responsibility of the client to check the bike at the store BEFORE setting out on any ride.

Customer agrees to return the bike in clean, UNDAMAGED condition to avoid any ADDITIONAL charges for repair, maintenance or replacement. Customer accepts use of the equipment, AS IS, in good condition and accepts full responsibility for care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced at the shops discretion and customer agrees to pay regular shop rates and retail prices for components replaced. Clean condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes.

Note: All bikes should be returned clean of mud and debris. Any bike not returned clean will be assessed a $50 additional fee.

Assumption of Risk: I understand and accept that renting this bicycle and participating in biking exposes me to many hazards and entail unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in bicycling. I choose
to participate in bicycling in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this bicycle and participating in bicycling. I understand the inherent risk involved in using this equipment, accept full responsibility for any and all such damage or injury which may result.

Waiver And Release: In consideration of Shell Seekers Vacations renting me this bicycle, I specifically release and forever discharge Shell Seekers Vacations and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this bicycle and participating in bicycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Shell Seekers Vacations or its affiliates, officers, agents, or employees. It is my intent by the Waiver And Release Agreement to release Shell Seekers Vacations and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of Shell Seekers Vacations or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this bicycle or participating in bicycling, I will have no right to make a claim or file a lawsuit against Shell Seekers Vacations or its affiliates, officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage.

I HAVE CAREFULLY READ THIS AGREEMENT IN ITS ENTIRETY AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.

FURTHERMORE I AGREE TO THE TERMS OF THE SHELL SEEKERS VACATIONS BICYCLE RENTAL AGREEMENT ABOVE.

Shell Seekers Vacations Binding Golf Cart Agreement and Policies (if applicable)

Please read carefully before signing and returning. In consideration for the rental of the golf cart, Guests agree to the following conditions. In the event that I violate any of the following conditions, I agree and understand that further use of the golf cart may be revoked immediately and without notice:

1. Promise to return the golf cart to the location provided immediately upon completion of the rental period in as good condition as I received the same, normal wear and tear accepted. I will operate the golf cart safely
   and responsibly, and I will preserve and protect the golf cart from loss or damage to the cart itself, my person or property, and the persons or property of others. I agree and understand failure to comply with the terms of this agreement will result in a forfeiture of my rental fees and deposit. I agree to be legally and financially liable for all costs of repairs to the golf cart and for the loss, damage and/or injuries to my person or property and the persons or property of others regardless of fault. I agree to reimburse the golf cart owner for such unrecoverable costs, including but not limited to deductibles and any uninsured losses.
2. Agree to hold harmless, defend and indemnify Shell Seekers Vacations, for any and all damages and claims of any nature whatsoever that may arise from the use of said golf cart during the time of the rental period, including but not limited to claims for damages to the golf cart itself, my person and property and the persons and property of others.
3. Agree to become familiar with the operation and use of said golf cart and any other instructions provided to me regarding the cart, and to operate the golf cart in accordance with said instructions. I agree to contact Shell Seekers Vacations if I have any questions or concerns about operating the golf cart or if my guest or I have caused
   any damage to the golf cart or others through the use of the golf cart. I agree to examine and inspect the safety and mechanical condition of the golf cart, reporting any concerns or problems before driving the vehicle.
4. Understand that a golf cart is subject to the same laws and regulations pertaining to motor vehicles and therefore agree that the golf cart will be operated in accordance with the laws of the State of Florida and the local laws of Walton County, including but not limited to the requirement that persons driving the golf cart must not be under the influence of alcohol and/or illegal drugs. I further agree that I personally will be responsible for all moving and/ or parking violations issued to said cart while it is in my possession, under my control, or at any time during the condominium/house rental period. I agree that I will not operate the golf cart in the surf or allow salt water to come in contact of mechanical or electrical components.
5. Agree that only persons who are 21 years or older, possess a valid driver’s license and insurance as required by law shall be permitted to drive the golf cart. I further agree not to exceed the maximum occupancy of the golf, including children.
6. Agree the privilege of using the golf cart can be revoked without notice by Shell Seekers Vacations in their sole discretion, for any violation of this agreement. I further agree I shall not be entitled any rental refund or deposit for such revocation of privilege.
7. Understand that if the golf cart should become inoperable through no fault of mine, Shell Seekers Vacations will take reasonable steps to have the vehicle repaired. In the event the golf cart cannot be repaired or replaced, a refund will be issued towards the unused rental agreement period.
